This website is owned and operated by Pyjama Ltd. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors services and products generally for the use and /or rental at parties, events and festivals, plus similar related projects in Hong Kong. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

No person under the age of 18 may order alcohol through the use of this website.

When buying an item or service, you agree that: 

(i) you are responsible for reading the full item listing before making a commitment to buy it: 

(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process either through this website or us quoting and you subsequently paying a corresponding invoice.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. 

All equipment items are supplied on rental basis only and remain the sole property of Pyjama Ltd or our agents and contractors.

Bookings will be confirmed (subject to availability) when we have received full payment or an amount as previously agreed.  Balance payments are due on the date stipulated.

Rental prices of equipment and loss/breakage/damage charges can be found on this website  The hirer agrees to compensate at the stated price for any  loss/breakage/damage of items hired.

Rental is for up to 5 days at the same price so you can get the equipment well in time for your event and return when convenient afterwards.  For large items such as tents and marquees, rental is for up to 7 days at the same price to allow time for installation and dismantle.  Longer rentals are possible at an extra rate agreed with your sales person.

Glassware is provided in glass racks for convenient loading into our commercial dishwasher. All liquids from the glassware should be emptied for easy transport back to our warehouses; post-event washing is not required.

Chinaware should be scraped of food waste; post-event washing is not required unless your food product will stain our equipment.

When renting items, you agree that: 

(i) you are responsible for reading the full item listing before making a commitment to rent: 

(ii) you have carefully checked the details of the rental including an accurate delivery address, the correct date and time of the delivery and the correct date and time for collection after your event.

(ii) you enter into a legally binding contract to rent an item when you commit to rent an item and you complete the check-out payment process either through this website or us quoting and you subsequently paying a corresponding invoice.

Renter must inform us beforehand if there are any stairs or other delivery challenges and agrees to pay the required fee for extra manpower required as determined by Pyjama Ltd.
 

For self-pickup of rental items, customers are responsible for all logistical arrangements once the equipment has been prepared for you. This includes coordinating third-party transportation and managing equipment returns. All pickups and returns must be personally handled by you or your authorised agent to/from our 22/F warehouse unit.

Cancellation of paid up bookings should be made in writing. Less than 2 days before the booked date, the full price is payable.  Between 2 to 5 days before the booked date, deposit will be forfeited.

In the event of Typhoon Signal 8 or above, or a Black Storm Warning, both parties reserve the right to postpone the event and reschedule another date that is convenient to both parties.

Where extra logistics or labour is required we will liaise with the client prior to the cancellation of the event. The client is responsible for any costs paid out or due to be incurred due to postponement or cancellation.

Unless stated otherwise, rented or supplied equipment is at all times exclusively at the risk of the client at the venue of the event. Pyjama Ltd accepts no liability for any incident involving our equipment and the client hereby indemnifies Pyjama Ltd against all claims for damage to property or injury to persons. Suitable insurance should be taken out to cover the client's liabilities for the term of the event. 

Acceptance of our goods on site constitutes acceptance of our Terms and Conditions.

The hirer is responsible for ensuring that casual staff are covered by appropriate Employees' Compensation Insurance.

Casual staff should be employed for a minimum of 4 hours

Formal Events: Staff are required to wear all black. This includes a black shirt, trousers, and shoes for men, or similar for women, unless alternative instructions are provided.

Casual Events (e.g., beach events): Staff should wear jeans or shorts, as appropriate for the weather, unless alternative instructions are provided.

The client agrees to provide adequate soft drinks/water for all staff 

For events over 6 hours duration the client agrees to provide a short break and offer adequate food.

Missed and delayed payments will incur a Late Payment Fee. This fee is calculated at 5% of outstanding payment per month.

To the maximum extent permitted by applicable law, in no event shall Pyjama Ltd, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

Pyjama Ltd is in no way liable for any financial losses or otherwise of the Event Owner for any operations and activities for the Event quoted here beyond the immediate control of Pyjama Ltd and as stated in your agreement.

To the maximum extent permitted by applicable law, Pyjama Ltd assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of The Hong Kong Special Administrative Region of The People's Republic of China, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in The Hong Kong Special Administrative Region of The People's Republic of China. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
